Webinar: Periodic Payments for Future Damages in a Health Care Liability Claim

This webinar will focus on Subchapter K of Chapter 74 of the Texas Civil Practice and Remedies Code—known as the periodic payments statute.  The webinar will address the mechanics of preserving the right to periodic payments of a jury’s future damages awards, as well as the trial court’s and the parties’ burdens in connection with that determination.  It will focus on the recent decisions of Virlar v. Puente, No. 20-0923, ___ S.W.3d ___ (Tex. Feb. 17, 2023) and Columbia Valley Healthcare v. A.A., 654 S.W.3d 135 (Tex. 2022) issued by the Texas Supreme Court in the last 12 months.  The webinar will cover the procedural and substantive holdings addressing the interpretation and application of Subchapter K as determined by the court in those cases.  The webinar will also cover the court’s determinations in Virlar regarding a challenge to the statutory dollar-for-dollar settlement credit found in Chapter 33 of the Texas Civil Practice and Remedies Code under the Open Courts provision of the Texas Constitution.
