Join us on Wednesday, March 24, 2010 for a discussion on the Fifth Circuit's recent holding in Trinity Universal Ins. Co. v. Employers Mut. Cas. Co., the rationale for the holding and the effect the ruling has on the insured and the insurer. The presenters will discuss the Fifth Circuit's application of the Texas Supreme Court decision of Mid-Continent Ins. Co. v. Liberty Mut. Ins. Co., and how its prohibition on contribution and equitable subrogation among insurers does not apply to defense costs. The discussion will include law on the insurer's right to recover defense costs from other carriers and other potential distinctions and/or applications of Mid-Continent.
