Michelle has been practicing appellate law for more than 30 years, and she fully admits to being an appellate law “geek.”  In today’s legal environment, however, appellate lawyers are not simply that group who prefer writing briefs to picking juries.  Appellate lawyers today are specialists that fill a vital role on the legal team, assisting from the start of a lawsuit with drafting pleadings, defending against improper discovery requests, challenging and defending experts, crafting dispositive motions, and then helping the trial team handle the jury charge, trial motions and briefs, and post-verdict filings. 

Yes, Michelle still writes briefs and makes oral arguments.  But Michelle’s roles as an appellate specialist at Cooper & Scully include being a “go-to” person for novel research issues and complex pretrial filings, being a “safety net” for purposes of preserving issues for appeal, and, if the case goes south, being the “cleaner” for purposes of advocating for reversal. 

Michelle has been Board Certified in Civil Appellate Law since 2000.  She has handled more than 250 appeals and original proceedings in a variety of courts, including the Texas Supreme Court, all Texas courts of appeals, the Fifth Circuit Court of Appeals, and other appellate courts around the nation.  Michelle also prepares amicus briefs on important issues being addressed by the Texas Supreme Court.  And, she is admitted to practice before the United States Supreme Court. 

Michelle has experience in many areas of the law, including insurance coverage and bad faith, medical malpractice and health law, construction defects, premises liability, products liability, legal malpractice, employment, governmental entities, and intellectual property, among others.  Michelle recently persuaded the Dallas Court of Appeals that the claim against her client arising out of the 2014 Ebola crisis was a health care liability claim, and the Texas Supreme Court unanimously affirmed that decision (Coming Attractions Bridal v. Texas Health Resources). 

In other appellate wins, Michelle and her team recently obtained reversal of a summary judgment based on the opponent’s failure to state the grounds in its motion (Steeltec v. Fish & Ski); obtained dismissals based on inadequate Chapter 74 expert reports (Columbia v. Bush and Lopez v. Guiding Light); and protected client documents based on the medical peer review privilege (In re Christus Santa Rosa).  She and her team also obtained a JNOV setting aside a $2 million jury verdict against her client (Miller v. Superior Forestry).

One of Michelle’s favorite cases involved reversal by the Texas Supreme Court of nearly fifty years of Texas precedent, which had prohibited a trial court from changing its mind about a new trial order unless it did so within 75 days of the original judgment.  See In re Baylor Med. Ctr. of Garland, 280 S.W.3d 227 (Tex. 2008) (orig. proceeding).  In a subsequent opinion in this same case, and in a companion case also handled by Cooper & Scully, the Texas Supreme Court again changed Texas law by holding that trial courts must give reasons for granting a new trial and that new trial orders are reviewable by mandamus.  See In re Baylor Med. Ctr. at Garland, 289 S.W.3d 859 (Tex. 2009) (orig. proceeding); In re Columbia Med. Ctr. of Las Colinas, 290 S.W.3d 204 (Tex. 2009) (orig. proceeding). 

Michelle is serving her second term as Chair of the Texas Pattern Jury Charge Committee for Volume 3, Malpractice, Premises, Products for 2023-24.  She has been a member of the Committee off and on since 2001.  In 2019, Michelle was invited to join the International Association of Defense Counsel and also is a member of the Texas Association of Defense Counsel.  In 2014, Michelle served as the Chair of the Appellate Law Section of the Dallas Bar Association.  And, the Dallas Bar Foundation elected Michelle as a Fellow.

Michelle is a double University of Texas at Austin graduate (yes, she has orange blood!).  She loves to watch football (especially the Longhorns and the Dallas Cowboys) and is the longtime commissioner of her fantasy football league.  She also enjoys cooking, travel, movies, mystery novels, and gardening.  On the gardening note, Michelle serves on the board of directors for the Texas Discovery Gardens at Fair Park, a year-round, organically maintained, urban botanical garden and butterfly house. 

Michelle is rated AV PreeminentTM 5.0 out of 5.0 by Martindale-Hubbell.  Also, her peers have voted her to the Texas Super Lawyers® list by Thomson Reuters Legal (2003-2023) and to D Magazine’s “Best Lawyers in Dallas” (2018-2019).  In 2013 and 2022, American Lawyer Media recognized Michelle as a “Top Rated Lawyer in Appellate Law,” based on her AV PreeminentTM rating by Martindale-Hubbell, and, in 2010, Thomson Reuters recognized her as one of the top appellate lawyers in the nation in Super Lawyers® Corporate Counsel Edition.
